Lindsay Lohan is being sued by a clothing manufacturer that claims that her reputation as a drug-taking, troubled star is hurting the brand. The company, DNAM Apparel Industries, wants $5 million from Lohan, money that she clearly doesn’t have.
Back in January, Lohan has sued DNAM for $1.1 million over the licensing agreement for her leggings line 6126. Now, the company is firing back with its own lawsuit, E! News confirmed.
DNAM filed a breach-of-contract counterclaim in California Friday, claiming that her troubled reputation has torpedoed the sales for the line and the company. The leggings line was briefly a hit in 2010, but since then, sales have declined as Lohan continued to be in the headlines for all the wrong reasons. In the suit, DNAM says that since 2010, retailers haven’t been buying “because they did not want to be associated with Lohan's drug addled image.”
Kristi Kaylor, who worked with Lohan on 6126, said that the countersuit is “frivolous and misrepresents the facts” in a statement to E!. “DNAM knows that it is in breach of the 6126 licensee agreement, and this suit is clearly nothing more than a transparent defense maneuver. Lindsay and I worked for over three years to build the 6126 brand and ensure its success; DNAM is merely trying to get out of honoring its financial obligations.”
Lohan’s attorney also sent a similar statement to TMZ. “The license agreement does not have a morals clause that allows the company to suspend payment for any behavior,” attorney Perry C. Wander said. “The contract is not in LL name thus she cannot be held personally liable. The cross claim is therefore frivolous and totally without merit and will be defended vigorously."
